TERMS OF SERVICE

By commissioning me, you agree to ALL terms and conditions listed below.I reserve the right to decline your request for any reason.

I. PERMISSIONS AND COPYRIGHT1. As the artist, I retain every right to my artwork, which means I may:
• Upload it to any social media, gallery, and portfolio.
• Use the image to promote myself.
• Record videos (speedpaints) and upload them.2. As a commissioner, you may:
• Repost the image to any of your social media with visible credit, preferably direct links/@'s to my profile. My username is @nerygees on Twitter, Instagram, Tumblr, and Twitch, so credit me accordingly.
• Use it to decorate your profiles (Twitter, Instagram, Twitch, etc.), avatars, banners, wallpapers, etc.
• Modify, edit, copy or trace my artwork without my permission and use it privately, for example, device wallpapers, art practice, personal room decor, etc.3. You may not:
• Claim my artwork as yours or say you made it.
• Modify, edit, copy or trace my artwork without my permission and post it publicly.
• Redistribute my artwork commercially, for use in printed merchandise, or as promotion of goods and services without my permission.
• Buy, sell or trade it as an NFT or involving any other sort of cryptocurrency, regardless of whether it is a commercial order or not.II. CONTACT AND COMMUNICATION1. Discussion of commissions can be conducted via these methods:

• Discord: @nerygees2. The client must provide at least one clear and concise visual reference. Please supplement the visual reference with any important information I may need to know to correctly draw the character. If you can't find a pose reference, a stick figure drawn by you can be of huge help! :)III. PAYMENT/PROCESS INFORMATIONMY COMMISSIONED ART IS A DIGITAL PRODUCT AND WILL NOT BE SHIPPED TO YOU.1. Payment in USD through PayPal or Venmo.2. 50% of the payment must be made upfront. Once the sketch is approved by the client and all major revisions/modifications are done, the rest of the payment should be sent. Payment plans can be discussed + full upfront payments are always welcome!3. Let me know when payments have been sent. I will not continue the artwork until I've received the due payments, regardless of the deadline. You can keep track of my progress and due payments through Trello.4. If you sent the payment as "Goods and Services", Paypal requires you to confirm you've received the "item". Be mindful that the payment will remain on hold until you've specified this to Paypal.IV. REFUND POLICY1. The client reserves the right to cancel a commission at any time, for any reason, and without explanation. Refunds will be given based on how much work is done.• sketch: 90%

• line and flat color: 30%2. If the commission is cancelled (by me or the client) before work has started, the client will receive a full refund.3. No refunds will be given for completed or nearly completed commissions.4. If I, the artist, cancel the commission due to my inability to complete it at any state, a full refund will be given.V. WORKFLOW PROCESS1. Time of completion may vary. If you have a deadline for the artwork, please let me know at least two weeks prior. Artwork due in one week from request will include a 50% penalty fee. I will not accept your commission if I am given less than a week of time. Exceptions can be made based on complexity of piece.2. Please be mindful that I have a life apart from art, and your commission may be delayed due to school or personal life. My schoolwork includes creating a lot of art as well. Please respect that I WILL take breaks from work by drawing and posting fanart/personal work in between commissions.2. Any major changes or revisions must be made at the sketch approval stage. This includes any significant changes to a character’s pose, clothes, body shape, expression, or redrawing parts of the image. After the sketch has been approved, no major edits or changes will be made. If the commissioner requests additional edits after the approved sketch, a price for the edits may be discussed.Not all changes are major, so don't hesitate to let me know if you'd like something altered or fixed!2. If I, the artist, make any errors in the character design, accessories, or any other visual elements specified in the provided visual references, I will make these edits at no additional cost.VI. NSFW & COMMERCIAL USE1. You must be 18+ to purchase an NSFW commission. NO EXCEPTIONS!2. You must be 18+ to purchase a commission for commercial use. Contracts are only valid if both parties are 18+. I will not agree to a commercial commission without a signed contract. Details will be modified accordingly.
